You must be at least 18 years old and a licensed or aspiring Physician Associate (PA) to use the Services. By registering, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.

• You must create an account to access most educational content (e.g., the QBank).
• You are responsible for safeguarding your credentials and for all activity under your account.

• The Services and content (including questions, explanations, diagnostics/imaging descriptions, and references) are for educational purposes only.
• No medical advice: The Services do not provide medical, legal, or professional advice and are not a substitute for independent clinical judgment or institutional policies.

Except as expressly permitted, you may not copy, reproduce, distribute, publicly display, create derivative works of, or exploit our intellectual property in any way. Unauthorized use may result in immediate termination and legal action.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial educational use during your active subscription or access term. All rights not expressly granted are reserved by BEYOND PANCE LLC.

You agree you will not:

• Share, sell, rent, sublicense, or otherwise provide your account or our content to any third party.
• Copy, scrape, harvest, or download content (including via bots, crawlers, or automated tools) except as expressly allowed by us in writing.
• Use our content to create competing products, study materials, or commercial services.
• Reverse engineer, modify, or attempt to bypass security, access controls, or usage limits.
• Upload or transmit malware, disrupt the Services, or interfere with other users’ access.
• Use the Services to train or fine-tune AI or LLM systems without our prior written permission.

Violations may result in immediate suspension or termination and may expose you to civil or criminal liability.

• Access to certain features (e.g., QBank Elite, practice exams) may require a purchase or subscription. Prices and features may change.
• Except where required by law or expressly stated by us, all purchases are final and non-refundable.

Upon termination, your license ends and you must cease all use of the Services. Sections that by their nature should survive (e.g., Intellectual Property, Disclaimers, Limitation of Liability) will survive termination.

The Services may link to third-party websites or integrate third-party tools. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms and privacy policies.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, BEYOND PANCE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO BEYOND PANCE FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.

You agree to defend, indemnify, and hold harmless BEYOND PANCE LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another.

If you believe content on the Services infringes your copyright or other intellectual property rights, please contact us with: (a) your identification, (b) a description of the work you claim is infringed, (c) the URL/location of the allegedly infringing material, (d) your contact information, and (e) a statement of good-faith belief and accuracy. These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Michigan, without regard to its conflict of laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Ingham County, Michigan.

• Severability: If any provision is held unenforceable, the remaining provisions will remain in effect.
• No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
• Entire Agreement: These Terms constitute the entire agreement between you and BEYOND PANCE regarding the Services, and supersede all prior agreements or understandings.

The BEYOND PANCE™ Career Hub and Job Manager features (collectively, “Job Manager”) allow employers, recruiters, and other authorized representatives to post employment opportunities and related content (“Job Listings”). By submitting a Job Listing, you agree to the following terms in addition to all other provisions of these Terms of Use:

• Accuracy & Legitimacy: All job information must be truthful, accurate, and represent a legitimate employment opportunity.
• Compliance: All postings must comply with applicable employment, anti-discrimination, privacy, and advertising laws.
• Prohibited Content: Listings may not contain misleading, defamatory, discriminatory, or inappropriate material.
• Review & Removal: BEYOND PANCE reserves the right to review, edit, or remove any job posting without notice at its discretion.
• Employer Accounts: Employers must register through the Employer Dashboard and are responsible for account activity.
• Payment & Featured Listings: Fees may apply for certain listing types. All payments are non-refundable once published unless otherwise stated.
• No Guarantee of Results: BEYOND PANCE does not guarantee visibility, applications, or hires from postings.
• Liability Disclaimer: BEYOND PANCE LLC is not a party to any employment transaction or hiring decision arising from postings on the platform.
